Public Officials including National Assembly Members to Resign by March 8 to Run for Re and By-Election

The National Election Commission (NEC) of the Republic of Korea announced that public officials, including members of National Assembly and heads of local governments, shall resign from their posts by March 8, if they want to run for the re and by-election scheduled to be held on April 7.

 

Under the Article 53 of the Public Official Election Act, people who are restricted from becoming a candidate due to their posts shall resign their posts by 30 days (March 8, 2021) before the election day in order to run for the re and by-election to be held on April 7: including public officials provided in the State Public Officials Act and the Local Public Officials Act; full-time executives of government-invested enterprises, local public corporations, and local industrial complex; and journalists.  However, when proportional representation members of local council wish to run for the re and by-election as constituency of their respective local councils, they need to resign before candidate registration.

 

When they notify resignation to their respective organization, they are considered resigned even if their resignation is yet to be formally accepted.

 

With regard to resignation of National Assembly members running for April 7 re and by-election, when their resignation is notified to the NEC by February 28, the respective by-election will be held on coming April 7. If such notice is received after March 1, the election will take place along with the 20th Presidential Election on March 9, 2022.
